UBC Guidelines For Generative AI Tools

Freedom of Information and Protection of Privacy Act (FIPPA)- Protecting students’ personal information

The aim of the present circular is to refresh knowledge of everyone of the Freedom of Information and Protection of Privacy Act (FIPPA) and the importance of protecting student personal information at UBC. 

Please refer to the Section 12 of the Privacy Fact Sheet reads:

“12. Students’ names, mailing addresses, email addresses, and phone and fax numbers are not considered to be “contact information” under FIPPA. This is because students attend UBC in a personal, rather than a business, capacity. All information about students, including their names, is personal information and is protected under FIPPA.”

The principles captured by Section 12 mean:

1. Any and all student related information that is deemed to allow the identification of an individual cannot be communicated to third parties, including to instructors, faculty or/and administrators without the explicit prior consent on the part of the student. Any survey that collects student information should ensure student consent to share the information is granted in advance, under the appropriate FIPPA safeguards. Any release, distribution and/or sharing of student registration information to any activity is deemed protected personal information that falls under FIPPA safeguards. 

2. Any consented sharing of information related to students must, by definition and practice, take place exclusively over UBC servers, meaning: via UBC-issued emails. Personal information cannot be shared – even if consented – over servers that store information outside of Canada, for instance like Gmail, Hotmail, Outlook or any similar services. 

3.  Instructors and students are strongly encouraged to use UBC-issued email addresses to communicate. Each individual at UBC is issued a UBC-based email that should be used for the conduct of institutional work. 

4. This circular is not a substitute for legal advice. Please read the Privacy Fact Sheet and FIPPA safeguards first. If you have specific questions about FIPPA, and how best to proceed, contact the Office of the University Counsel in the first order of things. 

5. This circular will be included for discussion in one of the Fall 2025 department meeting packages. After its discussion it will be uploaded to the EDST website for reference.
